Nowadays, the trend of shopping for branded second-hand fashion is in the spotlight, especially among generation Z and millennials who are increasingly concerned with sustainable consumption. A recent <\/span><a href=\"https:\/\/newsroom.thredup.com\/news\/thredups-11th-annual-resale-report-reveals-consumers-continue-to-embrace-secondhand-amid-economic-uncertainty\"><span style=\"font-weight: 300\">report<\/span><\/a><span style=\"font-weight: 300\"> even predicts that the second-hand fashion market will nearly double in the next few years, reaching a turnover of $350 billion.<\/span><\/p>\n<p><span style=\"font-weight: 300\">The turnover of second-hand fashion varies across online and offline stores. Despite being a huge business opportunity, this phenomenon poses significant risks to brands. One of them is the circulation of counterfeit branded second-hand clothing.\u00a0<\/span><\/p>\n<h2 id=\"mcetoc_1i19ef5ep0\"><span style=\"font-size: 28px\"><b>Second-hand clothing market and brand infringement<\/b><\/span><\/h2>\n<p><span style=\"font-weight: 300\">In terms of Intellectual Property Rights (IPR), there is actually nothing wrong with the sale of branded second-hand clothing. This is due to the &#8220;<\/span><a href=\"https:\/\/en.wikipedia.org\/wiki\/First-sale_doctrine#:~:text=The%20first%2Dsale%20doctrine%20(also,products%20embodying%20its%20intellectual%20property.\"><span style=\"font-weight: 300\">first sale doctrine<\/span><\/a><span style=\"font-weight: 300\">&#8221; in IPR law. Based on the doctrine, after the initial sale, the buyer has the right to sell, lease, or distribute the product with intellectual property rights without requiring additional consent from the intellectual property rights holder.<\/span><\/p>\n<p><span style=\"font-weight: 300\">It becomes an issue of legal infringement if the second-hand clothing sold turns out to be counterfeit. According to the <\/span><a href=\"https:\/\/www.uspto.gov\/page\/about-trademark-infringement#:~:text=What%20is%20trademark%20infringement%3F,the%20goods%20and%2For%20services.\"><span style=\"font-weight: 300\">WTO<\/span><\/a><span style=\"font-weight: 300\">, trademark infringement occurs when a trademark or service mark is used without the permission of the registered mark owner so as to cause confusion, deception, or misunderstanding as to the source of the goods or services.<\/span><\/p>\n<p><span style=\"font-weight: 300\">The recent case of <\/span><a href=\"https:\/\/www.thefashionlaw.com\/chanel-v-what-goes-around-comes-around-timeline-of-a-resale-lawsuit\/\"><span style=\"font-weight: 300\">Chanel vs What Goes Around Comes Around (WGACA)<\/span><\/a><span style=\"font-weight: 300\"> highlights the risk of brand infringement in the second-hand clothing market which includes claims of trademark infringement, counterfeiting, and dilution. Previously, Chanel had also filed a similar lawsuit against luxury goods retailer TheRealReal (TRR). Another similar claim case is <\/span><a href=\"https:\/\/uclawreview.org\/2020\/12\/14\/chanel-v-the-realreal-luxury-meets-resale\/\"><span style=\"font-weight: 300\">Tiffany Inc. vs eBay Inc<\/span><\/a><span style=\"font-weight: 300\">.<\/span><\/p>\n<h2 id=\"mcetoc_1i19ef5ep1\"><span style=\"font-size: 28px\"><b>Market opportunity and brand protection<\/b><\/span><\/h2>\n<p><span style=\"font-weight: 300\">The second-hand market can actually be an opportunity for brands to reach more consumers, build loyalty and even contribute to sustainability issues. At the same time, brand owners can make some efforts to protect their intellectual property rights.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 300\">There are several brand protection efforts that can be implemented, including:<\/span><\/p>\n<h3 id=\"mcetoc_1i20gh0990\"><span style=\"font-size: 24px\">1. Authentication<\/span><\/h3>\n<p>Brand owners work with second-hand merchants or platforms to verify the authenticity of second-hand goods that they claim to be genuine branded goods.\u00a0 This has been done by several <a href=\"https:\/\/news.bloomberglaw.com\/us-law-week\/the-resale-market-boom-what-sellers-and-brands-need-to-know\">well-known brands<\/a>, such as Gucci, Burberry, Stella McCartney, and Alexander McQueen.<\/p>\n<h3 id=\"mcetoc_1i20ghh6t1\"><span style=\"font-size: 24px\">2. Brand protection program<\/span><\/h3>\n<p>Establish a comprehensive plan that includes offline and online monitoring, reporting, and enforcement mechanisms to tackle counterfeiting.<\/p>\n<h3 id=\"mcetoc_1i20ghts22\"><span style=\"font-size: 24px\">3. Consumer education<\/span><\/h3>\n<p>Raise awareness about the risks of buying counterfeit products through public campaigns, websites, and social media.
