\"rekordasiCounterfeit products often attract consumer interest due to their significantly lower prices compared to genuine products. As a result, many consumers, whether consciously or unconsciously, purchase and use these products for various purposes.<\/span><\/p>\n

However, in some cases, especially for consumer goods, counterfeit products can pose a danger to consumer safety. For brand owners, the widespread circulation of counterfeit products clearly harms them and negatively impacts their reputation and profits.<\/span><\/p>\n

To gain a deeper understanding of the impact of counterfeit products and the efforts being made to combat them, Integrity Indonesia interviewed Mr. Tarto Sudarsono, Head of Cross-Border Crimes Section II, Directorate of Enforcement and Investigation, Directorate General of Customs and Excise, Ministry of Finance, Republic of Indonesia.<\/span><\/p>\n

Recordation as an effective strategy<\/b><\/h3>\n

According to Mr. Tarto Sudarsono, there are several strategies employed by Indonesian Customs to monitor the circulation of counterfeit goods. One such strategy is recordation.<\/span><\/p>\n

Customs recordation is carried out by registering the brand by the brand owner, enabling Customs to monitor registered branded products when they enter Indonesia. If any suspicious import activities related to registered brands are detected, Customs will notify the brand owner.<\/span><\/p>\n

“The more <\/span>recordations,<\/span> that are done, the more optimal Customs’ supervisory role becomes in tackling suspected counterfeit goods at the borders,” he stated.<\/span><\/p>\n

Addressing the circulation of counterfeit goods requires proactive cooperation between brand owners and Customs. Recordation is a proactive step for brand owners, <\/span>while Customs plays a role in educating about customs recordation.<\/span><\/p>\n

“At the beginning of 2024, Customs launched the <\/span>CVPR (Custom Visit to Potential Recordant) program.<\/span> This program involves visits to companies that <\/span>are potential candidates for recordation<\/span>,” he explained further.<\/span><\/p>\n

What is meant by “potential companies”? First, these are Indonesian companies, even though their products are imported. Second, their products have become targets of counterfeiting. Through these visits, Customs encourages these companies to register their trademarks.<\/span><\/p>\n

Stakeholder support in brand protection<\/b><\/h3>\n

Collaboration between Customs and brand owners in protecting brands is not sufficient without the support of other stakeholders, including consumers.<\/span><\/p>\n

Consumers have the right to report sightings of counterfeit goods <\/span>circulation of a brand to the brand owner.<\/span> Based on these reports, <\/span>the brand owner <\/span>can conduct further investigations and collaborate with relevant authorities to take action.<\/span><\/p>\n

Besides consumers, other essential parties involved are private entities that provide brand protection services. One such entity is <\/span>Integrity Indonesia<\/span><\/a>, through its <\/span>Brand Protection<\/span><\/a> services, which helps clients safeguard their intellectual property rights. These services <\/span>include brand investigation, non-use investigation, anti-counterfeiting, and parallel trade investigation.<\/span><\/p>\n

Tailoring its services to client needs, Integrity Indonesia can <\/span>help report these cases to relevant law enforcement authorities, such as the police, the National Agency of Drug and Food Control (BPOM), Customs, or other authorities.<\/span><\/p>\n

Integrity Indonesia is also prepared to assist clients in registering with the customs recordation system. Additionally, we can act as examiners in the authentication process at the Customs office when suspicious products are seized.<\/span><\/p>\n
